TERMS AND CONDITIONS
(PURCHASE AGREEMENT)
THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS, OBLIGATIONS, AND THE LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
This Purchase Agreement shall remain unaltered, unsupplemented, nor amended by any other Agreement written or implied. The Agreement applies to your purchase of The V Machine's computer system(s) and related products, services, and support sold by The V Machine in the United States. When you accept delivery of theV Machine, NPV, NPV LG SLI, Vex2, A1.1, or SLIM VIZ System(s) you accept and are bound to the terms and conditions of this Purchase Agreement. All sales of The V Machine's computer systems are final. Return of opened product boxes will not be accepted. Return of unopened product boxes (product(s) must remain unopened in the boxes in which they were shipped) will be received by The V Machine and subject to a full refund of the purchase amount less shipping, handling, and 15% restocking charges. You shall be obligated to notify The V Machine when cancelling an order(s). If an order is cancelled prior to shipping, The V Machine will provide a full refund of the purchase price. You shall be bound by this Agreement to notify The V Machine immediately of any change in your order and cancel or return your purchase pursuant to the above terms and conditions.
Product Purchases shall made by credit card. Shipping charges and taxes are additional unless otherwise advertised at the time of sale. Loss or damage that occurs during shipping by a carrier is the Carrier's responsibility. You shall be obligated to notify The V Machine within 3 days from the date of damage that you believe your purchase in whole or in part is damaged. The damaged system(s) must be returned per the terms and conditions of sale to The V Machine and a new system(s) will be sent to you at no additional charge. You shall be obligated to accept the new system(s).
The V Machine will provide estimated shipping dates and shall not be responsible for delays that may occur. Because each system is manufactured to order the average order to ship time varies from one to two weeks. Quantity purchase may take slightly longer.
All of The V Machine systems' compoents are warranted for three years by the individual OEM, (original equipment manufacturer) unless stated otherwise. All software shall be warranted and supported by the applicable licensor(s). The V Machine makes no warranties except to provide those warranty statements in effect on the date of the purchase from the OEM. Neither The V Machine, the compoent OEM(s), nor the software licensor(s) shall be obligated to honor any such warranties and services until The V Machine is in receipt of payment in full for the system(s) to be warranted or serviced.
The title to The V Machine's software will remain with the applicable licensor(s) subject to the license agreement that is part of the software package and you agree that you will be bound by such license agreements.
You herein agree that The V Machine shall not be liable beyond the remedies set forth, including but not limited to any liability for system(s) not being shipped within the estimated time frame, system(s) not available for use, lost profits, loss of business, lost and/or corrupted data, and software conflicts. Furthermore, The V Machine will not be liable for any consequential, special, indirect, or punitive damages, or for any claim by any third party. You further agree that the remedy for any and all liability claims related to the purchase of a system(s), shall be limited to the invoiced cost of your purchased system(s).
Any and all claims and disputes between you and The V Machine shall be resolved in Binding Arbitration utilizing the AAA, American Arbitration Association in The Commonwealth of Pennsylvania. Neither you nor The V Machine shall arbitrate any claim as a class action or consolidated claim.
